Welcome to Drive, operated by Designing Around. These Terms & Conditions govern your use of the Drive service located at https://drive.designingaround.com. By accessing or using Drive, you agree to comply with and be bound by these terms. If you do not agree, please refrain from using the service.

Acceptance of Terms

By registering for an account or using Drive, you confirm that you are at least 13 years of age and possess the legal capacity to enter into a binding agreement. If you are under 13, you are not permitted to use Drive. Users between 13 and 17 must have parental or guardian consent.

Account Registration and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized access or security breach. Drive reserves the right to suspend or terminate accounts violating these terms.

Content and User Responsibilities

You retain ownership of your uploaded content, but grant Drive a non-exclusive, worldwide, royalty-free license to store, process, display, and transmit your files solely to provide and improve the service. You agree not to upload content that is illegal, harmful, abusive, defamatory, or infringes third-party rights. Drive is not liable for the accuracy, safety, or legality of user-uploaded content.

Prohibited Activities

Using Drive to distribute malware, spam, phishing content, or exploit vulnerabilities
Automated scraping, crawling, or data harvesting without express written permission
Impersonating any person or entity or misrepresenting your affiliation with Drive
Interfering with or disrupting Drive’s servers, networks, or security mechanisms

Intellectual Property

All trademarks, logos, and proprietary software associated with Drive are owned by Designing Around or its licensors. Nothing in these terms grants you rights to use such intellectual property except as expressly permitted herein.

Limitation of Liability

Drive is provided “as is” and “as available” without warranties of accuracy, reliability, or fitness for a particular purpose. To the fullest extent permitted by law, Designing Around disclaims all liability for indirect, incidental, or consequential damages arising from your use of Drive.

Termination

Drive may suspend or terminate your access at any time, with or without notice, for violations of these terms or for any reason in its sole discretion. Upon termination, your right to use Drive ceases immediately, and your stored data may be deleted in accordance with our Privacy Policy.

Governing Law and Dispute Resolution

These Terms & Conditions are governed by the laws of the United States, without regard to its conflict of law principles. Any disputes arising from or relating to these terms shall be resolved exclusively in the federal or state courts located in San Francisco County, California.

Changes to These Terms

We may update these Terms & Conditions periodically. The most current version will always be posted at https://drive.designingaround.com/terms-conditions. Continued use of Drive after changes constitutes acceptance. Last updated: March 15, 2025.
